Terms of Service

The agreement between you and BenefitHub, Inc. governing your use of insurance.benefithub.com and our insurance quote-comparison service.

Effective date: September 14, 2026

Overview

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and BenefitHub, Inc., a Delaware corporation with its principal place of business in New York, NY and its affiliates and subsidiaries including BenefitHub, Inc.’s wholly-owned insurance agency Insurean, Inc. (“Insurean”) (collectively, "BenefitHub," "we," "us," or "our"), governing your access to and use of the website located at insurance.benefithub.com and any related applications, tools, products or services (collectively, the "Site"). The Site allows consumers to request, compare, and obtain insurance quotations from third-party insurance carriers and to apply for and purchase insurance products through Insurean, in its capacity as a licensed insurance producer.

Please read these Terms carefully. They include a mandatory arbitration provision and class action waiver in Section 17 that affect your legal rights, including your right to a jury trial and your right to participate in a class action.

By accessing or using the Site, creating an account, requesting a quote, or clicking "I Agree" (or a similar affirmation) where presented, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, located at insurance.benefithub.com/privacy which is incorporated into these Terms by reference. If you do not agree to these Terms, you may not access or use the Site. Also in these Terms, the terms “include”, “includes” or “including” or “such as” mean “including but not limited to”.

1. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract under applicable law to use the Site. By using the Site, you represent and warrant that you meet these requirements, that all information you submit is true, accurate, current and complete, and that you are requesting insurance information for yourself or for another person or entity for whom you have proper legal authority to act.

2. Nature of Our Services

BenefitHub, Inc.’s subsidiary, Insurean, is a licensed insurance agency and insurance producer, and not an insurance company or insurance underwriter. Through our subsidiary, we are licensed to transact insurance business in all fifty (50) U.S. states plus Puerto Rico and the District of Columbia, subject to the specific lines of authority held in each jurisdiction. You may verify our licensing status and that of our individual producers at any time through the National Insurance Producer Registry (NIPR) at nipr.com, or by contacting us using the information in Section 20 of these Terms.

When you use the Site, we help you request quotations for, compare, and apply for insurance products issued by unaffiliated, third-party insurance carriers ("Carriers") with which we hold appointments or contractual relationships. The information that you provide or application created via use of the Site may be used by us to provide an estimate of the terms, conditions and costs of coverage. In providing the foregoing services:

  • We do not underwrite, issue, or guarantee any insurance policy. All coverage decisions, underwriting, pricing, policy issuance and terms and conditions of the insurance to be offered are made solely by the applicable Carrier, in its sole discretion, based on its own underwriting guidelines.
  • Quotes are estimates only and are not binding. Application for an insurance quotation through this Site does not constitute a binder of insurance coverage and are for informational purposes only. Any premium, rate, or coverage information displayed on the Site is an estimate based on the information you provide and is subject to change upon full underwriting review by the Carrier and may be subject to receipt of additional information or other conditions. A quote is not an offer, application, binder, or guarantee of coverage.
  • No coverage exists until confirmed in writing by the Carrier. Submitting information through the Site, receiving a quote or completing an online application does not, by itself, create, bind, extend, alter or cancel any insurance coverage. Coverage is only effective once you receive confirmation of binding or a policy from the applicable Carrier.
  • We may receive compensation. BenefitHub may receive commissions, fees or other compensation from Carriers when you purchase a policy through the Site. This compensation does not affect the price that you pay for coverage and does not influence the objectivity of the quotes displayed, but you acknowledge that BenefitHub has a financial relationship with the Carriers appearing on the Site. Additionally, BenefitHub may share commissions or referral fees with business partners, subject to all applicable regulations and laws. You acknowledge and agree to said methods of compensation.
  • We do not guarantee that displayed quotes represent the best or lowest rates, terms or coverage available in the market, whether from Carriers on the Site or elsewhere.

Nothing on the Site constitutes insurance, legal, financial or tax advice and under no circumstances should you regard any information that you may access on or obtain from the Site as a recommendation, advice or complete description of any products, services or plan. You should carefully review any policy documents, declarations pages and disclosures provided directly by a Carrier before making a purchasing decision and consult a licensed professional with questions specific to your situation. The Site is not intended as a solicitation for insurance in any jurisdiction where BenefitHub or its subsidiaries are not licensed.

You acknowledge that completion of any form or application available on or through the Site does not bind insurance coverage. Furthermore, you acknowledge that your acceptance of a quotation and tendering of the requisite premium is required prior to binding coverage and policy issuance.

3. Your Account

Certain features of the Site may require you to register for an account, including saving quotes, managing an application or accessing policy documents to the extent that they are available. You agree to: (a) provide accurate, current, and complete information during registration and to keep it up to date; (b) maintain the confidentiality of your login credentials; (c) notify us immediately of any unauthorized use of your account or any other breach of security; and (d) accept sole responsibility for all activity that occurs under your account, whether or not authorized by you, except to the extent caused by our gross negligence or willful misconduct. We are not liable for any loss or damage arising from your failure to safeguard your account credentials.

We reserve the right to suspend or terminate your account, or to refuse registration, at our discretion, including where we suspect fraud, misuse or a violation of these Terms.

4. Communications Consent

By providing your telephone number(s) or email address(es) via the Site or otherwise to us, or by clicking "Continue," "Submit," "Get My Quote," or a similarly labeled button, you expressly consent to receive calls, text messages (SMS/MMS), pre-recorded or artificial voice messages, and emails from BenefitHub, its affiliates, and the Carriers or licensed insurance agents to whom your request is referred, at the number(s) and address(es) you provide, including through the use of an automatic telephone dialing system or prerecorded/artificial voice. These communications may include marketing and informational messages about insurance products and services, and may be sent even if your number is on a state or federal Do-Not-Call registry (- for example, it may take some time between when your contact information is added to such registry and when such communications actually stop, or instances where you have submitted an inquiry or application -).

Consent is not a condition of purchasing any product or service. Message and data rates may apply, and message frequency will vary. You may revoke your consent to receive text messages at any time by replying "STOP" to any message, and may opt out of marketing emails by using the unsubscribe link included in each email. You may opt out of marketing phone calls by informing the caller or by contacting us using the information in Section 20 of these Terms. We will process opt-out requests within a commercially reasonable time, and you may continue to receive certain transactional or service-related communications (- for example, communications necessary to complete a quote that you requested or to service an existing policy -) even after opting out of marketing communications, to the extent permitted by law.

5. Prohibited Conduct

You agree not to, and not to permit any third party to:

  1. provide false, fraudulent or misleading information, or another person's information without proper authorization, or submit speculative, fictitious or "test" quote requests;
  2. use the Site for any unlawful purpose, or in a manner that violates any applicable federal, state, or local law or regulation, including insurance, telemarketing or data privacy laws;
  3. access or attempt to access the Site using any robot, spider, scraper, crawler or other automated means, or engage in screen scraping, data mining, or bulk data extraction of quotes, rates or other content;
  4. circumvent, disable or otherwise interfere with security-related features of the Site, including rate limiting, CAPTCHAs, bot-detection, IP-based restrictions or other access controls;
  5. reverse engineer, decompile, disassemble or otherwise attempt to derive the source code or underlying algorithms of the Site;
  6. frame, mirror or embed any portion of the Site without our prior written consent, or take any action that imposes an unreasonable or disproportionately large load on our infrastructure;
  7. impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  8. deep-link to any portion of this Site for any purpose without our written consent;
  9. use the Site to build a competing product or service, or to train, fine-tune, evaluate or otherwise develop any artificial intelligence or machine learning model, as further described in Section 7 of these Terms; or
  10. use the Site for any commercial, financial or other similar purpose without our prior written consent.

We reserve the right, in our sole discretion, to investigate suspected violations of this Section 5 of these Terms and to suspend, throttle or terminate access by any user, account, device, IP address or network associated with such activity, without notice, and to pursue all available legal and equitable remedies, including under the Computer Fraud and Abuse Act and applicable state computer crime statutes.

6. Technical and Security Measures

We may, at our discretion, deploy rate limiting, device fingerprinting, IP address monitoring, CAPTCHA or similar challenges, and other bot-detection or fraud-prevention technologies to protect the integrity of the Site and the accuracy of the quoting process. We may block, throttle or terminate access without prior notice where we reasonably believe such measures are necessary to prevent abuse, fraud or violations of these Terms.

7. Intellectual Property

The Site and all content, features, and functionality available through it — including text, graphics, logos, quote-comparison tools, software, and the design, structure, and "look and feel" of the Site — are owned by BenefitHub or its licensors and are protected by U.S. and international copyright, trademark and other intellectual property laws.

"BenefitHub" and our related names, logos and marks, including “BenefitHub Direct”, “BenefitHub: Your Wallet Will Thank You”, “Insurean”, “Benefits+”, “Voluntary Benefits Marketplace” and “VB Marketplace”, are trademarks and the exclusive property of BenefitHub. You may not use them without our prior written consent.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own personal, non-commercial purpose of obtaining insurance quotes and related services. This license does not include any right to: (a) resell or make commercial use of the Site or its content; (b) copy, reproduce, distribute, publicly display, or create derivative works from any content on the Site; or (c) use any data mining, robots, or similar data-gathering tools.

No use for AI training. You may not use the Site, or any content, output or data obtained from the Site, as input, training data, fine-tuning data, a retrieval or grounding source or evaluation data for any artificial intelligence or machine learning system, without our prior written consent.

Any feedback, suggestions or ideas that you voluntarily submit to us regarding the Site may be used by us for any purpose without compensation or attribution to you. By submitting any material to BenefitHub, you irrevocably transfer and assign to BenefitHub, and forever waive and agree to never assert any copyrights, "moral" rights or other rights that you may have in such material. BenefitHub is free to use, without obligation of any kind, any ideas, concepts, techniques or know-how contained in any communication that you send or information that you provide to BenefitHub for any purpose whatsoever, including developing and marketing products and services. By using the Site, you may submit, or BenefitHub may gather, certain limited information about you and your usage of the Site. Subject to the terms of our Privacy Policy, BenefitHub is free to use such information for any purpose that it deems appropriate. You also agree that you shall have no recourse against the Released Parties (defined in Section 11 of these Terms) for any use, including those uses described in the first sentence of this paragraph, of the above described content.

8. Third-Party Links and Co-Branded Content

The Site may contain links to, or content and functionality provided by, third parties, including Carriers, marketing partners or service providers, some of which may appear in a co-branded format bearing BenefitHub's name or logo alongside such third party's name or logo. These third-party sites and features are governed by their own privacy policies and terms and conditions, which we encourage you to review. We do not control and are not responsible for the content, accuracy, products, services or privacy practices of any third-party site or co-branded feature, and your use of same is at your own risk. Inclusion of a link or co-branded feature does not constitute an endorsement thereof by BenefitHub.

Additionally, BenefitHub has not reviewed all of the sites which are linked to our Site, and the existence of such links does not indicate our approval or endorsement of any material contained on any linked site. BenefitHub is not responsible for the contents of any site linked to our Site; your connection to any such linked site is at your own risk.

9. Accessibility

BenefitHub is committed to making the Site accessible to individuals of all abilities and to complying with applicable accessibility standards and laws. If you experience difficulty accessing any portion of the Site or have suggestions for improvement, please contact us using the information in Section 20 of these Terms, and we will work to address your concern.

10. No Warranties and Liabilities

There is no warranty that any information (including quotes, rates or coverage information) or service provided or referenced by this site is either merchantable or accurate, that such information or service will fulfill any of your particular purposes or needs, or that such information or service does not infringe on any third party rights. Except for any express warranties stated on this site, if any, the information and services provided or referenced on this site are provided "as is" and with all faults, and the entire risk as to satisfactory quality, performance, accuracy and effort is with you as the user. While BenefitHub uses reasonable efforts to include accurate and up-to-date information on the BenefitHub site, BenefitHub makes no warranties or representations as to its accuracy or that any defects will be corrected. BenefitHub may periodically add, change, or improve any of the information, products, services, programs and technology described on the site without notice. BenefitHub assumes no liability or responsibility for any errors or omissions in the content of the site. In fact, your use of the site is at your own risk. Neither BenefitHub nor any other party involved in creating, producing or delivering the site is liable for any direct, indirect, incidental, consequential or punitive damages arising out of your access to, or use of, the site. For example, BenefitHub assumes no responsibility for, and will not be liable for, any damages from any viruses which may affect your computer equipment or other property on account of your access to, use of, or downloading from, the site.

We do not make any commitments about the content within the Site, the specific functions of the Site, the Site itself, or its reliability, availability or ability to meet your needs. We provide the Site and any product or service provided or referenced by the Site “as is”. To the fullest extent permissible by applicable law, BenefitHub hereby disclaims all warranties of any kind, either express or implied, including the warranty of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from a course of dealing, performance, usage or trade practice with respect to the Site and any product or service provided by BenefitHub.

This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

11. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will BenefitHub, its affiliates, or their respective officers, directors, employees, or agents (“Released Parties”) be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site or these Terms, regardless of the legal theory asserted, even if BenefitHub has been advised of the possibility of such damages. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses arising from or relating to: (1) Your access to, use of, or inability to access or use the Site, Site Content, or any Third-Party Materials; (2) Any reliance placed by you on the completeness, accuracy, or existence of any advertising or information acquired through the Site; (3) Costs, fees, or losses associated with cancelled, interrupted, or delayed insurance plans or arrangements; (4) Errors, misinformation or failures in communication, whether human or technological; or (5) Any accidents, personal injury, property damage, or other unexpected events occurring in connection with the Site (including its products or services).

Except where prohibited by law, the Released Parties’ total aggregate liability to you for all claims arising out of or relating to the Site or these Terms will not exceed the greater of (A) the total compensation, if any, that BenefitHub received in connection with your use of the Site during the twelve (12) months preceding the event giving rise to the claim, or (B) one hundred dollars ($100.00).

In the event that you have a dispute, claim or controversy with any Carrier, Service Provider, linked site or any other third-party, including any other user of the Site, arising from or in connection with the use of the Site, you hereby agree to fully and forever release and discharge the Released Parties from any and all losses, damages, demands or claims of any kind or nature, whether known or unknown, which now or hereafter arise from, relate to or are connected with such dispute or your use of the Site. If you are a California resident, you hereby expressly waive and relinquish all rights and benefits under California Civil Code Section 1542, which says as follows: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” If you are not a resident of California, you hereby expressly waive and relinquish all rights and benefits under any law of any jurisdiction of similar effect with respect to any such losses, damages, demands or claims described in the first sentence of this paragraph.

You expressly acknowledge and agree that the warranty disclaimers and limitations of liability set forth above are fundamental elements of the "basis of the bargain" between you and us. You agree that BenefitHub would be unable to provide the Site on an economically feasible basis without these limitations. These provisions represent a fair and reasonable allocation of risk between you and us.

Nothing in these Terms limits BenefitHub's liability for its own gross negligence, willful misconduct or fraud, or affects any rights that you may have under applicable insurance law that cannot be waived. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. For residents in such jurisdictions, the limitations and exclusions in this section are intended to be as broad and inclusive as permitted by the applicable laws of said jurisdictions. If any portion of this section is held to be invalid under applicable law, the invalidity of such portion shall not affect the validity of the remaining portions. In all such cases, the Company’s liability will be limited to the maximum extent permitted by applicable law. The limitations of liability set forth in this section shall survive the expiration or termination of these Terms and your use of the Site.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your breach of these Terms; (b) your use or misuse of the Site; (c) any information you submit in connection with or through the Site, including any material misrepresentation made in connection with an insurance application; or (d) your violation of any law or the rights of any third party. We reserve the right to assume or participate, at your expense, in the investigation, settlement and defense of any such action or claim.

13. Termination

We may suspend or terminate your access to the Site, or any account you maintain, at any time, in our sole discretion, with or without notice, for any reason, including if we believe that you have violated these Terms. You agree that BenefitHub shall not be liable to you for any such termination. Your sole remedy for dissatisfaction with the Site is to terminate your use of the Site. If you wish to terminate your account or to have your personal data (as further described in our Privacy Policy and Section 16 of these Terms) deleted, then you should discontinue all use of the Site and contact us as indicated in our Privacy Policy, as applicable. These Terms do not affect the terms of any insurance policy you have purchased through a Carrier; to cancel or discontinue an issued insurance policy, you must contact the applicable Carrier directly, subject to the terms of that policy.

14. Electronic Communications and Signatures

By using the Site, you consent to receive communications from us electronically, including notices, disclosures and agreements, and you agree that any electronic signature, click-through acceptance or other electronic acknowledgment that you provide has the same legal effect as a handwritten signature, to the fullest extent permitted under the federal E-SIGN Act of 2000 and applicable state law. To access and retain electronic communications, you will need internet access, a current web browser, a valid email address and the ability to save or print communications for your records. You may withdraw your consent to electronic communications by contacting us at legal@benefithub.com.

15. Modifications to the Site and These Terms

We reserve the right to modify or amend these Terms and any policies contained in same at any time at our sole discretion. Any and all such changes will be published on the Site. We also reserve the right to change or update the Site or any portion(s) thereof, as well as limit your access to the Site or discontinue any portion(s) thereof, at any time at our sole discretion. Said modifications, amendments, changes or updates will only apply to your access or use of the Site from the effective date of such changes. If you do not agree with any such modifications, amendments, changes or updates, then you should discontinue all use of the Site and contact us, as indicated in our Privacy Policy, to terminate your Account or request the deletion of your data as applicable. You agree that the Released Parties shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Site or any portion(s) thereof. Furthermore, you agree that neither the course of conduct between you and BenefitHub, nor trade practice, shall act to modify any provision of these Terms. We reserve the right to limit the availability of any aspect of the Site to any person, geographic area or jurisdiction we so desire, in our sole discretion, and to limit any aspect of the Site that we provide.

16. Privacy

Our collection, use, and disclosure of your personal information is described in our Privacy Policy. By using the Site, you consent to the practices described in the Privacy Policy.

17. Dispute Resolution: Binding Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights.

(a) Informal Resolution First. Before filing a claim against BenefitHub, you agree to first contact us at our address below in Section 20 of these Terms and attempt in good faith to resolve the dispute informally for at least thirty (30) days.

(b) Agreement to Arbitrate. If a dispute is not resolved informally, you and BenefitHub agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your relationship with BenefitHub (a "Dispute") will be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may bring an individual action in small claims court, and either party may seek injunctive or other equitable relief in court to prevent actual or threatened infringement, misappropriation or violation of a party's intellectual property rights.

(c) Arbitration Procedures. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration will be conducted by a single arbitrator and, unless you and BenefitHub agree otherwise, will take place in the county where you reside, or another mutually agreed location, or by telephone or videoconference. The cost of the filing, administration and arbitrator fees shall be split equally between you and BenefitHub, unless the total relief sought is $2,500 or less, in which case we will pay all filing, administration and arbitrator fees associated with the arbitration. You must submit a request for our payment of fees along with any demand that you make. If the arbitrator determines that the claim that you assert is frivolous, then you agree to reimburse us for all of the fees that we paid in association with the arbitral proceedings that you would otherwise have been obligated to pay under said AAA rules. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

(d) Class Action and Jury Trial Waiver. You and BenefitHub each waive the right to a trial by jury and the right to participate in a class action, class arbitration or representative action. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If this class action waiver is found to be unenforceable as to a particular claim or dispute, then that claim or dispute (and only that claim or dispute) will be resolved in court rather than in arbitration.

(e) Right to Opt Out. You may opt out of this arbitration agreement by sending written notice to us at the address set forth in Section 20 of these Terms within thirty (30) days of the later of the publication date of these Terms or the date that you first accept these Terms, stating your name, mailing address, phone number and email address and providing a clear statement that you wish to opt out of arbitration. If you opt out, neither you nor BenefitHub will be required to arbitrate Disputes, but all other provisions of these Terms, including the venue and governing law provisions in Section 18 of these Terms, will continue to apply.

(f) Severability of Arbitration Provisions. Except as provided in subsection (d) of this Section above, if any part of this Section 17 of these Terms is found to be invalid or unenforceable, the remainder of this Section 17 of these Terms will remain in full force and effect.

18. Governing Law and Venue

These Terms are governed by the laws of the State of New York, U.S.A., without regard to its conflict-of-laws principles. Subject to Section 17 of these Terms, you and the Released Parties agree that any Dispute not subject to arbitration (including any claim excluded from arbitration or brought after a valid opt-out under Section 17(e) of these Terms) will be brought exclusively in the state or federal courts located in New York County, New York, U.S.A., and you consent to the personal jurisdiction of those courts.

19. General Provisions

(a) No Agency. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between you and BenefitHub, other than Insurean's role as your insurance producer with respect to any application that you submit on or through the Site.

(b) Assignment. You may not transfer or assign any rights or obligations that you have under these Terms without our prior written consent. We reserve the right to freely transfer or assign our rights and obligations under these Terms to any third-party at any time.

(c) Severability. If any portion of these Terms (other than as addressed in Section 17(f)) is deemed unlawful, void or unenforceable by any court of competent jurisdiction, then the portion of the Terms at issue shall either be revised by the court to an enforceable standard that resembles the parties’ original intent, or be struck in whole, and the remainder of these Terms shall persist and control.

(d) No Waiver. Failure by us to exercise or enforce any legal right or remedy reserved to us under applicable law or any provision of these Terms shall not constitute a waiver of our rights or future enforcement of those rights or any other provision of these Terms. Our failure to enforce any provision of these Terms will not be deemed a waiver of that provision.

(e) Entire Agreement. These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and BenefitHub regarding the Site and supersede any prior agreements or understandings, whether written or oral, with respect to the subject matter hereof.

(f) Force Majeure. BenefitHub will not be liable for any delay or failure to perform resulting from causes outside its reasonable control.

(g) Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.

(h) Survival. All provisions of these Terms, which by their nature must survive the termination or expiration of your relationship with us in order to give effect thereto, shall survive such termination or expiration. Without limiting the generality of the foregoing, all provisions of the following will survive any such expiration or termination: Section 1 (as it relates to your representations and warranties), Section 2 (as it relates to disclaimers), subsection (d) and the last sentence of Section 3, Sections 7 and 8, Sections 10 through 12, the second and third sentences of Section 13, the first sentence of Section 14, and Section 15 through 19.
